RETURN OF ITEMS:
a. Members shall be given a fixed number of free deliveries/collections as per their selected Membership Plan. Members are advised to schedule their deliveries on the same day as returns to optimise use of their membership. If any Member decides to get books delivered and returned through separate delivery slots, then each of these instances would reduce available free deliveries/collection for the month by 1 count.
b. In the event the Member is not available during the scheduled pick up and drop off time for the exchange, this would be deducted from the total number of free deliveries for the Member as per the Membership Plan availed by the Member.
DAMAGE, REPAIR AND LOSS OF ITEMS:
a. The Member is liable to pay the cost of Repair in case the Item gets damaged, torn or altered in any way. Customers may be charged for any repairs required on such items. The repair charges will be determined by Squiggles and could be upto 50% of MRP of the Item. Repair charges can be deducted from the security deposit given by the Member when the item is returned.
b. An item is considered “damaged beyond repair” if it is returned to Squiggles in a condition that requires extensive repair or is incapable of being repaired and cannot be put into circulation. The Member is liable to pay the cost of replacement in case the Item gets damaged beyond repair. In such case, Squiggles would charge replacement charges up to the MRP of the item + INR 100 as restocking fees as determined by us. This amount shall be deducted from the refundable security deposit amount given by the Member during the relevant payment cycle. Repair and/or replacement charges can be deducted from the security deposit given by the Member when the item is returned.
c. The Member is liable to pay the cost replacement in case the Item gets lost. Customers may be charged for non-returned or lost items. In such case, Squiggles would charge replacement charges up to the MRP of the item + INR 100 as restocking fees as determined by us. Such replacement charges can be deducted from the security deposit given by the Member.
d. Should Squiggles find the cost of repair and/or replacement exceeds the deposit amount maintained by the Member in his/her account, then Squiggles reserves the right to invoice the Member for said charges which the Member shall pay within 15 working days.
HANDLING AND CARE OF ITEMS LENT:
a. All items remain the responsibility of the Member until the items are handed over to the representative of Squiggles;
b. Squiggles takes the utmost care to maintain items in good condition. Any damage beyond normal wear and tear, if found on the issued item during delivery should be promptly notified to the delivery executive when it being delivered by the member. Failure to check and report the same would be understood as the item being delivered in good condition with no damages.
c. Items cannot be subleased/rented/borrowed to any other person during the term of the loan by the Member;
d. The Member shall be responsible for the safe custody of the Items issued and delivered to him/her;
e. Lent items must not be annotated, marked, highlighted, coloured, bent or changed in any manner;
f. The Member shall be responsible for the loss or damage to the Items issued to him /her;
g. During re-stocking of the lent item, Squiggles has the right to identify any damage on the Item and levy charges as applicable to the Member. Notification of levy of charges could take upto two working days after the receipt of the returned Item by Squiggles.
h. Squiggles will not be giving any physical receipt of the library membership. The Member will be notified of his/her membership and other updates by e-mail/SMS on registered e-mail Id/mobile number only.
i. Squiggles reserves the right to cancel/replace any Item with equivalent item in case of unavailability or quality issue(s) even after the loan out request has been made by the Member.
j. Squiggles has the right to share reviews and testimonials/pictures shared by Members with us by either e-mail or by WhatsApp or social media tag. Squiggles shall not be responsible if any third party misuses this information or pictures/videos uploaded on our website.
k. Members are solely responsible for maintaining the confidentiality and security of their account information and password. If you reveal your password or share your account with anyone, you take full responsibility for your actions.
CANCELLATION or TERMINATION OR CHANGE IN MEMBERSHIP PLAN
a. Users will purchase Membership Plans. Should Members not select the auto renew option, the membership will automatically terminate at the end of the term. In this event members need to ensure all lent items are returned safely to Squiggles within 10 working days (2 weeks) from the end of the membership. In case an Item or Items is/are not returned within 10 working days (2 weeks), Squiggles will levy a fine of INR 50/week/Credit for every subsequent week that the items have not been returned. Squiggles reserves the right to deduct such fines from the security deposit of the Member.
b. The Security Deposit subject to deductions, if any shall be refunded to the Member within 15 working days post expiry of Membership Plan or from termination of Membership by either Party or after all lent items have been safely returned back to Squiggles, whichever is later.
c. Members can upgrade their Membership plans mid cycle (in the middle of the term). The same would be reflected in the beginning of the next membership month. In the event, a Member elects to terminate their Membership mid cycle, he/she will not be entitled to any refund of membership fees from Squiggles. The Security Deposit subject to deductions, if any shall be refunded to the Member within 15 working days post termination of Membership by either Party or after all lent items have been safely returned back to Squiggles, whichever is later
d. If any Member is found to be indulging in infringement of any Intellectual Property Rights of any publisher and/or author of any Book as described above, Squiggles shall terminate the Membership of the Member forthwith on obtaining such information and the security deposit and Membership Fees shall stand forfeited.
e. Further, Squiggles reserves the right to terminate the Membership of any Member if the Items lent have been returned damaged or lost more than three times since commencement of Membership.
