PLEASE READ THESE TERMS OF USE CAREFULLY. BY USING THIS WEBSITE AND ENROLLING AS A MEMBER, THESE TERMS SHALL BE BINDING UPON YOU.
ABOUT US
www.worldofsquiggles.com (hereinafter referred to as “SQUIGGLES”) is an online service provider for early learners, where we rent books and toys and deliver them as per membership plan for the members (hereinafter collectively referred to as the “SERVICES”). Squiggles is registered as a Micro Enterprise under the Micro, Small and Medium Enterprises Act, 2005.
REGISTRATION AND MEMBERSHIP
a. Only registered members post payment towards the chosen membership plan shall be eligible to avail the Services of Squiggles. Membership with Squiggles as well as usage of this website is subject to the Terms of Use mentioned herein as well as Privacy Policy displayed on our website.
b. Latest membership plans offered by Squiggles are included here. For any legacy plan not mentioned here, the details would be as specified during the purchase of the membership.
c. Membership term would be defined as the duration for which the membership plan has been purchased by the member during which the membership is active.
d. Membership start date will be confirmed by Squiggles within 24 hours of purchase of the plan after successful payment is made for the chosen plan. The same would be specified in the Member’s online profile.
e. Certain Credits (as described in membership plans above) shall be available to the Member as per the Membership Plan availed by them. Every item lent by Squiggles has a pre-assigned numeric value, defined as Credit. The same would be listed below the Item on the website and shall be visible to the Members at the time of leasing the Item(s).
f. During the membership term, if the Member chooses to upgrade the plan, the same would be effective only from the beginning of the next membership month. For example, if the membership has started on 8th Sep 2022 for a 6 month term. On 15th October should the member upgrade the plan, then the new plan would come into effect from 8th October. For some upgrades, effective date could be on the same day as determined by Squiggles.
g. Should members not select the auto renew option when available, the membership will automatically terminate at the end of the term. For example if the membership has started on 8th Sep 2022 for a 6 month term. The membership will end on 08th March 2023 unless the member has opted for auto renew option.
h. Membership with Squiggles is for the benefit of the Member as well as his/her family members residing with them. Members undertake that they shall not sub-let/deliver the Books and Toys lent to them by Squiggles to any third parties at any given time. Book and Toy may hereinafter individually be referred to as an ‘Item’. Books and Toys are hereinafter collectively referred to as ‘Items’.
i. Membership taken by the member is not transferable.
j. Membership fees shall be paid by the Member online as per the modes of payment available on the website as per the plan availed by him/her.
k. It is mandatory for every Member to maintain a security deposit (refundable) in their account based on their selected membership plan. Should any amount be deducted due to required repair, damage or loss of Books or toys lent then the same would be invoiced on their next order placed with Squiggles. Else, the amount may be deducted from the security deposit on return of the concerned Item(s) or at/before end of the membership as decided by Squiggles. The Security Deposit subject to deductions, if any shall be refunded to the Member within 15 working days post expiry of Membership Plan or from termination of Membership by either Party or after all Lent Item(s) are safely returned back to Squiggles, whichever is later.
l. Membership fees paid by the Members for availing Services are non-refundable.
m. Squiggles may decide to cease certain plans from time to time. In such an event Squiggles will notify member of the same via electronic media and provide alternative plans to change to.
n. Based on the membership plan that the member has subscribed to, member would get certain number of free deliveries every month. Members can avail this service only for that specific month. If the member has chosen not to avail this service, the free deliveries can’t be carried over to the next month in any case.
DESCRIPTION OF SERVICES
a. Squiggles is an online children’s library for facilitating easy access to books and toys. Members take library membership and we promise to deliver Books and/or Toys, as per the Member’s request and subscription plans mentioned on our website.
b. Squiggles may suggest Reading Age levels for various publications on its website. This is only a general guideline to enable searching through more relevant items in the collection. Members need to ensure that the rented Item is appropriate for their wards. However, Squiggles shall not be held responsible for any harm, injury, loss, agony caused to the Member or their ward by availing/ using the Item(s) lent.
RETURN OF ITEMS:
a. Members shall be given a fixed number of free deliveries/collections as per their selected Membership Plan. Members are advised to schedule their deliveries on the same day as returns to optimise use of their membership. If any Member decides to get books delivered and returned through separate delivery slots, then each of these instances would reduce available free deliveries/collection for the month by 1 count.
b. In the event the Member is not available during the scheduled pick up and drop off time for the exchange, this would be deducted from the total number of free deliveries for the Member as per the Membership Plan availed by the Member.
c. Scheduled exchanges for members will mention the list of items for return and for delivery. Members are expected to return all the listed items to the Squiggles delivery representative. However for any reason if certain items are not handed over during the exchange then, Squiggles will levy a fine of INR 25/week/Credit for every subsequent week that the items have not been returned. Squiggles reserves the right to deduct such fines from the security deposit of the Member or charge it when the member schedules the next delivery.
DAMAGE, REPAIR AND LOSS OF ITEMS:
a. The Member is liable to pay the cost of Repair in case the Item gets damaged, torn or altered in any way. Customers may be charged for any repairs required on such items. The repair charges will be determined by Squiggles and could be up to 50% of MRP of the Item. Repair charges can be deducted from the security deposit given by the Member when the item is returned.
b. An item is considered “damaged beyond repair” if it is returned to Squiggles in a condition that requires extensive repair or is incapable of being repaired and cannot be put into circulation. The Member is liable to pay the cost of replacement in case the Item gets damaged beyond repair. In such case, Squiggles would charge replacement charges up to the MRP of the item + INR 100 as restocking fees as determined by us. This amount shall be deducted from the refundable security deposit amount given by the Member during the relevant payment cycle. Repair and/or replacement charges can be deducted from the security deposit given by the Member when the item is returned.
c. The Member is liable to pay the cost replacement in case the Item gets lost. Customers may be charged for non-returned or lost items. In such case, Squiggles would charge replacement charges up to the MRP of the item + INR 100 as restocking fees as determined by us. Such replacement charges can be deducted from the security deposit given by the Member.
d. Should Squiggles find the cost of repair and/or replacement exceeds the deposit amount maintained by the Member in his/her account, then Squiggles reserves the right to invoice the Member for said charges which the Member shall pay within 15 working days.
HANDLING AND CARE OF ITEMS LENT:
a. All items remain the responsibility of the Member until the items are handed over to the representative of Squiggles;
b. Squiggles takes the utmost care to maintain items in good condition. Any damage beyond normal wear and tear, if found on the issued item during delivery should be promptly notified to the delivery executive when it being delivered by the member. Failure to check and report the same would be understood as the item being delivered in good condition with no damages.
c. Items cannot be subleased/rented/borrowed to any other person during the term of the loan by the Member;
d. The Member shall be responsible for the safe custody of the Items issued and delivered to him/her;
e. Lent items must not be annotated, marked, highlighted, coloured, bent or changed in any manner;
f. The Member shall be responsible for the loss or damage to the Items issued to him /her;
g. During re-stocking of the lent item, Squiggles has the right to identify any damage on the Item and levy charges as applicable to the Member. Notification of levy of charges could take up to two working days after the receipt of the returned Item by Squiggles.
h. Squiggles will not be giving any physical receipt of the library membership. The Member will be notified of his/her membership and other updates by e-mail/SMS on registered e-mail Id/mobile number only.
i. Squiggles reserves the right to cancel/replace any Item with equivalent item in case of unavailability or quality issue(s) even after the loan out request has been made by the Member.
j. Squiggles has the right to share reviews and testimonials/pictures shared by Members with us by either e-mail or by WhatsApp or social media tag. Squiggles shall not be responsible if any third party misuses this information or pictures/videos uploaded on our website.
k. Members are solely responsible for maintaining the confidentiality and security of their account information and password. If you reveal your password or share your account with anyone, you take full responsibility for your actions.
INTELLECTUAL PROPERTY RIGHTS
a. Squiggles does not permit copyright infringing activities and infringement of intellectual property rights of any publisher and/or author of any Book(s). Items rented by Members via this website is for Member’s information and personal use only and shall not be used, copied, reproduced, translated, distributed, transmitted, broadcasted, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective copyright owner. Copying or reproducing or redistributing the Items lent by Squiggles is expressly prohibited.
b. Without prejudice to the contents of clause (a) hereinabove, Members agree not to reproduce, translate, duplicate, copy, sell, resell or exploit for any commercial purposes, any Items taken on rent from us.
CANCELLATION or TERMINATION OR CHANGE IN MEMBERSHIP PLAN
a. Users will purchase Membership Plans. Should Members not select the auto renew option, the membership will automatically terminate at the end of the term. In this event members need to ensure all lent items are returned safely to Squiggles within 10 working days (2 weeks) from the end of the membership. In case an Item or Items is/are not returned within 5 working days (1 week), Squiggles will levy a fine of INR 50/week/Credit for every subsequent week that the items have not been returned. Squiggles reserves the right to deduct such fines from the security deposit of the Member.
b. The Security Deposit subject to deductions, if any shall be refunded to the Member within 15 working days post expiry of Membership Plan or from termination of Membership by either Party or after all lent items have been safely returned back to Squiggles, whichever is later.
c. Members can upgrade their Membership plans mid cycle (in the middle of the term). The same would be reflected in the beginning of the next membership month. In the event, a Member elects to terminate their Membership mid cycle, he/she will not be entitled to any refund of membership fees from Squiggles. The Security Deposit subject to deductions, if any shall be refunded to the Member within 15 working days post termination of Membership by either Party or after all lent items have been safely returned back to Squiggles, whichever is later.
d. If any Member is found to be indulging in infringement of any Intellectual Property Rights of any publisher and/or author of any Book as described above, Squiggles shall terminate the Membership of the Member forthwith on obtaining such information and the security deposit and Membership Fees shall stand forfeited.
e. Further, Squiggles reserves the right to terminate the Membership of any Member if the Items lent have been returned damaged or lost more than three times since commencement of Membership.
EVENT REGISTRATION AND PARTICIPATION
Squiggles from time to time conduct or host events, classes workshop etc online or offline in its own premises or in third party location (“ Event”). Event registration is open to active Squiggles members and non-members, as specified for each event. Participants agree to abide by the terms and conditions outlined herein.
a. Non-Refundable Registration: Event registration fees are non-refundable, except in cases where the Event is cancelled by Squiggles. Squiggles reserves the right to determine the refund policy for specific events.
b. Event Schedule: The schedule for the Event, including dates, timings, and activities, is subject to change at the discretion of Squiggles. Squiggles will make reasonable efforts to inform registered participants of any schedule changes through the preferred communication channel.
c. Event Cancellation: Squiggles reserves the right to cancel an Event at any time due to unforeseen circumstances, low enrolment, or any other reason. In the event of an Event cancellation initiated by Squiggles, registered participants will be notified, and a full refund (if applicable) will be provided to the registered participants.
d. Participant Conduct: Participants are expected to behave respectfully and responsibly during the Event. Any disruptive or inappropriate behaviour, as determined by Squiggles, may result in the participant’s removal from the Event without a refund.
e. Media Release: By participating in the Event, participants grant Squiggles the right to use any photographs, videos, or other media captured during the Event for promotional purposes, without any compensation to the participants.
f. Liability: Participants understand that participation in certain Events may involve physical activities and assume all risks associated with such activities. Squiggles and its organizers shall not be held liable for any injuries, accidents, losses, or damages sustained during the Event.
g. Medical Considerations: Participants are responsible for assessing their physical condition and suitability for participation in the Event. Participants with known medical conditions should seek medical advice and clearance before participating in physically demanding events.
h. Age Restrictions: Some Events may have age restrictions or specific requirements for participation, as outlined in the Event details. Parents or legal guardians are responsible for ensuring that their minors meet the age requirements and are adequately supervised during the Event.
i. Privacy: By registering for an Event, participants agree to the collection and use of their personal information as outlined in Squiggles’ Privacy Policy.
GIFT CARD
Squiggles offers gift cards that can be bought by customers and redeemed for library membership and other applicable product or services at Squiggles. Gift card redeemer or purchaser agrees to abide by the terms and conditions outlined herein.
a. Gift Card Redemption: Squiggles Gift card can be redeemed for Library membership, participation in library events and programs, purchase of books, or other applicable products available at Squiggles.
b. Card Value – The value of the Gift Card is determined at the time of purchase and can be used for multiple transactions until the balance reaches zero or it reaches its expiration date.
c. Expiration Date: Is determined at the time of purchase. Gift card cannot be redeemed after the expiration date.
d. Non-Refundable – Gift Cards are non-refundable and cannot be exchanged for cash or other forms of payment.
e. Lost or Stolen Cards- Squiggles is not responsible for lost or stolen Gift Cards. Replacement gift cards will not be given by Squiggles.
f. Use Restrictions – Gift Cards may only be used for transactions related to Squiggles Children’s Library services and products. They cannot be used to purchase other gift cards or for any illegal purposes.
g. Cash Value – Gift Cards have no cash value and cannot be used to pay fines, fees, or overdue charges
h. Balance Inquiry – You can check the balance of your Gift Card online at www.worldofsquiggles.com
i. Transferability – Gift Cards are transferable, but they may not be sold, bartered, or otherwise exchanged for consideration without Squiggles’ consent.
j. If the gift card is used towards the payment of refundable deposit for applicable Squiggles plan in such case – once the plan term is completed and the receiver does not wish to extend the membership any further in that case the refundable deposit amount (after any applicable deductions) will be refunded to the gift card itself or a new gift card will be issued as determined by Squiggles. Gift Cards are non-refundable and cannot be exchanged for cash or other forms of payment.

MEMBER REFERRAL PROGRAM
The referral program (“Program”) is open to all registered and active Squiggles members (“Referrers”) when it is made available on the Squiggles website and/or platform. Referrers must have an active subscription with Squiggles to participate in the Program. By participating in the Referral Program, Referrers agree to be bound by these Terms and Conditions outlined herein.
a. Referral Code and Sharing: Each Referrer will receive a unique referral code (“Referral Code”) that they can share with their friends, family, or acquaintances (“Referees”). The Referral Code is non-transferable and intended for personal sharing purposes only. Referrers must not engage in spamming, unsolicited emails, or any other unauthorized means to share their Referral Code.
b. Referral Incentives: For each successful referral, the Referrer will receive a specified number of reward points (“Reward Points”) as outlined in the Program. A successful referral is defined as a new customer (“Referee”) who signs up for a Squiggles subscription using the Referrer’s unique Referral Code. The Reward Points earned through successful referrals can be used by the Referrer to pay for their monthly Squiggles subscription fees and events hosted by Squiggles, as per the Program guidelines.
c. Referee Benefits: New Referees who use a valid Referral Code during sign-up will receive a specified discount or incentive as outlined in the Program.
d. Program Changes and Termination: Squiggles reserves the right to modify, suspend, or terminate the Referral Program at any time without prior notice. Any changes to the Referral Program will be communicated to active Referrers through the preferred communication channel.
e. Fraud and Misconduct: Squiggles reserves the right to disqualify any participant who engages in fraudulent or malicious activities related to the Referral Program. Squiggles may revoke Reward Points earned through fraudulent referrals and take appropriate action against the involved Referrer.
f. Reward Points Usage: Reward Points have no cash value and can only be used within Squiggles for paying for the monthly subscription and events hosted by Squiggles, as per the Program guidelines. Reward Points cannot be transferred or redeemed for cash. Reward points can only be redeemed by members with an active Squiggles subscription.
g. Compliance: All participants in the Referral Program must comply with Squiggles’ general Terms and Conditions and Privacy Policy. Failure to adhere to the Terms and Conditions may result in the loss of referral privileges and potential termination of the member’s subscription.
h. Liability: Squiggles shall not be liable for any losses, damages, or claims arising from participation in the Referral Program.
INDEMNITY
Members agree to defend, indemnify and hold harmless Squiggles, its proprietor, executives, affiliates, officers, agents, service providers, employees, etc., from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to lawyer’s fees) arising from: (i) your use of and access to this website and/or the Services; (ii) your violation of any term of these Terms; (iii) your violation of any third party right, including without limitation to any copyright, trademark, or other property, or privacy right. This indemnification obligation will survive termination, modification or expiration of these Terms and your use of the Services and Membership of Squiggles.
BINDING AGREEMENT
a. Minors, i.e., users under the age of 18 years are only allowed to access this website and use the Services with the approval of their parents/legal guardian. By availing/subscribing to the membership of Squiggles, you affirm that you are at least 18 years of age or possess legal parental or guardian consent and are fully able and competent to enter into this terms and conditions and you agree to abide by and comply with these Terms of Use.
b. These Terms of Use may be updated by Squiggles at any time at its sole discretion. Squiggles may send you notice(s) of changes to these terms and conditions.
ENTIRE AGREEMENT:
These Terms and the other policies posted on the website constitute the complete and exclusive understanding and agreement between you and Squiggles and govern your use of the Services and the website, superseding all prior understandings, proposals, agreements, negotiations, and discussions between the parties, whether written or oral.
If any provision or provisions of these Terms is held to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions of the Terms of Use shall not in any way be affected or be impaired.
GOVERNING LAW AND JURISDICTION:
The Terms of Use and the relationship between you and Squiggles shall be governed by the laws of India. Any claim including one arising out of the use of the Services and/or the website, is subject to the jurisdiction of courts in Pune only.
ELECTRONIC COMMUNICATION:
You consent to receive electronic communications from Squiggles. You agree that any communication, notice, agreement, or disclosure that we send to you electronically i.e., by e-mail or SMS, satisfies any legal communication requirements, including that such communications be in writing.
